Ontario’s New OHSA Requirements – What Employers and Constructors Need to Know

Ontario is raising the bar for workplace washroom standards. In 2024, Bill 190, Working for Workers Five Act, introduced significant changes to the Occupational Health and Safety Act (OHSA), targeting washroom facility requirements for employers and constructors on construction projects.

Starting July 1, 2025, employers must:

  1. Maintain cleanliness and sanitation of any washroom facilities provided for workers.
  2. Keep and make accessible records of the facilities’ cleaning schedules.

But that’s not all—additional regulations have clarified how these requirements will be implemented.

Let’s break it down.

New OHSA Regulations Coming in 2026

On November 29, 2024, Ontario released two new regulations that will take effect on January 1, 2026:

OHSA Regulation 480/24 – Washroom Facilities: Records of Cleaning

This regulation explains how employers and constructors can meet the obligation to make cleaning records available to workers. Options include:

  • Posting the record in a visible location near the washroom; or
  • Sharing it electronically with clear instructions for access.

The records must show the date and time of the two most recent cleanings.

OHSA Regulation 482/24 – Washroom Facilities: Construction Projects

This regulation updates O. Reg. 213/91 (Construction Projects) to require constructors to maintain detailed records of servicing, cleaning, and sanitizing washroom facilities. The record must include:

  • All service dates for the past six months or the duration of the project, whichever is shorter.

Starting January 1, 2026, constructors must comply with both Regulation 480/24 and Regulation 482/24.

What Employers and Constructors Should Do Now

To stay ahead of these changes, employers and constructors should review and update their workplace policies and procedures. Focus on:

  • Meeting the July 1, 2025 deadline for maintaining and recording washroom cleaning.
  • Preparing for the January 1, 2026 requirements to post or share cleaning records and track servicing details.
